These Terms & Conditions (“Terms”) govern your use of INTELLO Chat, a Meta Verified WhatsApp Business solution provided by INTELLO Solutions SPC LLC (“INTELLO,” “we,” “our,” or “us”). By accessing or using INTELLO Chat, you agree to be bound by these Terms.
If you do not agree, please do not use the Platform.
1. User Responsibilities
You agree to use INTELLO Chat only for lawful business purposes and in compliance with all applicable laws, regulations, and Meta’s WhatsApp Business policies.
Fraudulent, deceptive, or misleading practices (including spamming, phishing, or unauthorized marketing) are strictly prohibited.
You are solely responsible for the content of messages, campaigns, and communications sent via the Platform.
2. Account Security
You are responsible for maintaining the confidentiality of your account credentials (username, password, and API keys).
Any activity conducted under your account will be deemed your responsibility.
You must notify us immediately at support@intello.ae
if you suspect unauthorized use or breach of security.
3. Payments and Billing
By subscribing to INTELLO Chat, you agree to pay all applicable service fees as per your selected plan.
Payments are billed in advance (monthly or annually, depending on your subscription).
Failure to make timely payments may result in account suspension or termination.
All fees are non-refundable, unless otherwise required by law.
4. Data Protection and Privacy
You must obtain the necessary consent from your customers before sending them messages via WhatsApp.
You agree to comply with all applicable data protection laws (e.g., GDPR, UAE Data Protection Law).
INTELLO acts as a data processor and provides the platform, while you remain the data controller responsible for end-user data.
5. Compliance with Meta Policies
INTELLO Chat operates in line with Meta’s WhatsApp Business API policies and restrictions.
You must follow all Meta guidelines regarding message templates, opt-in, and content usage.
Violations of Meta’s policies may lead to suspension or termination of your WhatsApp Business account.
INTELLO is not responsible for account suspensions imposed directly by Meta.
6. Service Availability
We strive to provide continuous, reliable access to the Platform. However, we do not guarantee uninterrupted or error-free service.
Scheduled maintenance, updates, or technical issues may cause temporary downtime.
7. Limitation of Liability
INTELLO is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Platform.
Our total liability under these Terms shall not exceed the amount paid by you for the service in the preceding three (3) months.
8. Termination
We reserve the right to suspend or terminate your account if you:
Violate these Terms,
Breach Meta’s WhatsApp Business policies,
Fail to make timely payments.
Upon termination, your access to the Platform will be disabled and stored data may be deleted.
9. Changes to Terms
We may update these Terms at any time. The updated version will be posted on our website with the revised “Effective Date.” Continued use of the Platform constitutes acceptance of the updated Terms.
10. Governing Law & Jurisdiction
These Terms shall be governed by and construed under the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the courts of Abu Dhabi, UAE.
